Charter of Protection of Personal Data

The EMB company is one of the leaders in professional information in France and Europe. As such, it collects and processes a large number of personal data on its behalf and that of its customers and business partners. It is strongly committed to ensuring that its systems and practices comply with the provisions of the European Data Protection Regulation.

EMB (hereinafter referred to as “the body”, “we”, “us”) acts as controller within the meaning of European Regulation No 2016-679 of 27 April 2016 and the Act “Informatique et Libertés” of 6 January 1978, as amended (hereinafter, together, the “regulation”) on the processing of personal data caused by its website.

We undertake to comply with the applicable Regulations and to best protect the personal data of our partners, suppliers, users, visitors of the site as well as any other data subject (hereinafter “you”, “your”). As such, we have produced our DPO's declaration to the CNIL under the reference DPO-141213 dated 18/12/2023. The role of DPO is carried out by the company APORIA.

 

1. SCOPE

The purpose of this policy is to present to you how we process your personal data, via our website www.emb-europe.com (hereinafter referred to as the “site”).

It applies only to transactions (hereinafter “processings”) made on information about you as long as you are likely to be identified directly or indirectly (hereinafter referred to as “personal data”).

When we provide our services, we act on behalf of Clients or their subcontractors (hereinafter our “Partners”) as subcontractors. As a result, it is up to our Partners acting as controllers to provide information to the data subjects via their websites.

2. WHAT DONATIONS TO CARCASE PERSONNEL WE TRAIN AND WHY?

In accordance with the legislation in force, we have adopted the principle of minimization in the collection and collect only the data strictly necessary for the objective pursued and explained to the natural persons concerned, leaving them with full capacity to exercise their rights.

By visiting our website, you may have to transmit the following personal data to us:

2.1. When you use the contact form on our website:

  • Email address
  • Name, first name
  • Telephone and company name (optional)
  • Your wish (by means of a drop-down menu)
  • Subscription to our newsletter
  • Your message

2.2. When you log on to the site via cookies and tracers:

2.3. Use of the data collected:

We may use this personal data to:

  • Send you commercial information about our products, promotions, offers, as well as other information relating to our products or services tailored to your interests;
  • Provide you with information on products and offers of third parties – our customers or our business partners – in relation to your function and/or an interest identified in relation to your business or that of the organisation to which you belong;
  • Send political communications regardless of organization or party.

We will use this personal data as part of our activities that are the promotion of our own products and services and prospecting on behalf of third parties. They are used only within the strict limits laid down in the legislation in force.

2.4. Methods of sending information:

Depending on the contact details collected, EMB and its partners will be able to provide information by the following means:

  • Text message sent to a person (SMS or MMS, notification, e-mail, and/or any other form of electronic message);
  • Telephone;
  • Postal mail;
  • Web promotional banner;
  • Internet search engine.

2.5. Specific rules on profiling:

We may combine information about companies with information entrusted to natural persons under the conditions and for the purposes set out in this policy.

The methods of profiling that we use are to achieve manual or automated cross-checks, between business files and our contact databases (name, function, e-mail address, etc.), based on objective criteria (size, mains, computer equipment, etc.).

 

3. WHAT IS THE LEGAL WAY TRAINING TREATMENT WE DISPLAY?

EMB collects personal data on the basis of:

  • Your consent: when you fill in our contact form via our website or when you accept the deposit of cookies and tracers on your PC.
  • The performance of obligations under a contract: the collection of the personal data of our customers and users is necessary in order to fulfil the terms of the contract (e.g. subscription, subscription to an online service - free or paid...) and to ensure the provision of the subscribed service or the product acquired by the natural person concerned. Thus, in this context, the processing carried out is linked to the performance of the contract.
  • Our legitimate interest: in certain circumstances, the very nature of the service provided by us implies the collection of personal data from its customers and users and the transmission of this information to designated third parties (e.g. connection services). Such processing shall be considered as a reasonable expectation on the part of the person concerned in relation to the description of the service provided. Of course, we constantly assess whether our legitimate interest is not offset by your interest or by respect for your fundamental rights and freedoms.
  • A legal obligation to make processing compulsory: the regulatory context of an activity may make certain processing and data transfer mandatory (e.g. for billing services, etc.).

 

4. WHAT ARE OUR COLLECTION MODES?

4.2. By means of forms

Access, use, download, purchase or subscription to certain services or products involves the collection of personal data concerning the prospective customer or user. In these cases, when filling in the paper, electronic forms, the persons transmit information about them.

4.3. By telephone

We provide certain services by telephone and on this occasion may collect personal data. Where possible, the telephone contact is confirmed by sending an e-mail, thus allowing the person concerned to keep a written record of the conversation and to be able to exercise his rights at any time.

4.4. Indirect collection

In the case of private data collection (B2C), we may obtain personal data from third parties and pass it on to partners (see Chapter 5 – Who can access your personal data?).

In the case of professional data collection (B2B), we may obtain personal data from third parties or from public sources such as company websites or data in openData and pass them on to partners (see Chapter 4 – Who can access your personal data?).

In such hypotheses, we:

  • Let us conclude a contract with that third party;
  • Let us notify the persons of the transfer of their data to our files;
  • Let us indicate the source of the data in our files in order to ensure its traceability;
  • Let us inform the persons concerned of the arrangements for exercising their rights.

 

5. Who CAN ACCESS YOUR PERSONAL DATA?

As part of our activities, we may have to pass on your personal data to partners duly authorised by us for the following purposes:

  • Clients/partners who have subscribed to a service that may involve the collection of personal data of users in particular in the context of a request for connection or in the context of the creation of a prospecting file;
  • Providers, subcontractors and suppliers to perform services on its behalf (e.g. technical services, payment services, identity verification, providers of analytical solutions, chat, database management, hosting, storage, maintenance, etc.);
  • Other companies, financial institutions or law enforcement agencies/services for the prevention or detection of fraud, where such disclosure is necessary to safeguard our rights;
  • In cases where the law so provides or at the formal request of an authority (in particular in the context of judicial proceedings), public, semi-public or private bodies in the context of a public service mission;
  • Partners in the following uses:
    • - Commercial prospecting and marketing analysis
    • - Enrichment, multi-channel rental
    • - Profiling on interests (we may combine information about companies with information entrusted to natural persons under the conditions and for the purposes set out in this privacy policy)
    • - Statistical analyses
    • - KYC (Know Your Customer) : Individual validation / Identity verification / Fight against fraud

These third parties acting on our behalf are subcontractors within the meaning of the regulations. We contractually ensure that they act only under our instructions and implement appropriate technical and organisational measures, so that the processing of personal data they perform meets the requirements of the GDPR, ensures the protection of your rights and that they will not use your data for purposes other than those of which you have.

The conditions relating to the processing of personal data implemented by these providers and the rights you have in this respect are, unless expressly stated, the same as those described in this Policy.

In addition, in accordance with the legislative provisions in force, your personal data may be communicated to any administrative or judicial authority authorized by law which so requests.

6. COMBIENED TIME YOUR PERSONNEL CHANNEL DATA ARE STORED?

We ensure that your personal data are not kept for longer than is strictly necessary for the purposes pursued as set out in the policy and in accordance with the applicable Regulations and Acts. In this respect, the personal data used to respond to your requests for information and contact are kept in accordance with our legal obligations.

The shelf life depends on the activity concerned, the nature of the contact (customer or prospect) and the uses of the sector.

The company EMB keeps certain mandatory documents (invoices etc) for the legal retention period.

The retention period of personal data shall be set by default at 3 years for all processing operations of EMB and shall be destroyed as a result of this retention period.

Some data are stored for a shorter shelf life:

  • Data from prospects retained 3 years from last contact with us

The duration is sometimes linked to the relevance or necessity of its processing: customer data are kept for the duration of the business relationship.

In the case of judicial or administrative proceedings, your data will be kept for the period necessary for their resolution.

 

7. TRANSFER OF DATA FROM PERSONNEL OUT OF THE EUROPEAN UNION?

Personal data may be transferred to providers in a third country whose rules are not sufficient to provide adequate data protection measures. Together with these providers, we ensure that appropriate safeguards are implemented to ensure an equivalent level of protection, including through the signing of standard contractual clauses or any other document reporting proof of our commitment.

 

8. HOW DO WE PROTAKE YOUR DONATIONS TO PERSONNEL CHARACTER?

We ensure that your data is processed in such a way as to ensure an appropriate level of security through the introduction of technical and organisational measures.

Our organisation is part of a “Privacy by Design” approach to any processing of personal data, we take into account data protection through technical and organisational measures appropriate to the processing in question.

9. WHAT ARE YOUR RIGHTS ON YOUR PERSONAL DATA?

You have rights to your personal data, allowing you to correct, modify or delete them, such as:

  • Right of access,
  • Right of rectification,
  • Right to object (except for processing based on a contract, a legal obligation or vital interests),
  • Right to erasure (except for processing based on a legal obligation or the public interest),
  • Right to portability (except for processing based on legitimate interest, legal obligation, public interest or vital interests),
  • Right to restriction of treatment,
  • Right to define guidelines for the retention, erasure and communication of personal data after your death,
  • Right to lodge a complaint with a supervisory authority (in France, the CNIL) in the event that we are unable to respond properly to requests.

These rights may be exercised at any time, subject to certain conditions. We will do our utmost to comply with your request as soon as possible and at the latest within one month, unless there are some rules.

Or right to be forgotten: your personal data will be erased within a maximum of one month of receipt of your request.

 

10. HOW TO EXERCISE YOUR RIGHTS?

In order to ensure the prompt and correct processing of your requests for the exercise of rights, the following information is necessary: name, first name, e-mail address, postal address, telephone number. In some cases (right of access, right to portability and rights for heirs), in particular in order to protect you against identity theft and to verify the validity of your request, you will have to attach a copy of a proof of identity and provide any information or document useful to support your request.

11. UPDATE OF CONFIDENTIALITY POLICY

Our personal data protection policy can be changed and updated at any time. In the event of a change or update, the revised personal data protection policy will be put online on the website, with the latest update date.
